Srinagar, Sept 23 (JKNS): A migrant landowner has alleged violation of court orders directing maintenance of status quo at her property in Ahmad Nagar, Soura Srinagar, claiming that the opposite party entered the land and erected a tent.
The property belongs to Shakuntala Jalali Bhan and is subject to proceedings before the High Court of Jammu & Kashmir and Ladakh in WP(C) No. 1373/2023, titled Shakuntala Bhan versus UT of J&K and others.
According to the family, the attorney representing the landowner visited the site and later lodged an FIR at the concerned police station regarding the alleged entry and activity on the property.
Speaking to news agency JKNS, Bhan said court directions require status quo to be maintained at the disputed property and questioned how the opposite party could enter the land and erect a tent.
“As per the court order, no one from either side can go to the spot of the land. Then how can the opposite party go there and even set up a tent?” he said.
Documents available with JKNS further show that in an order dated February 7, 2024, the High Court directed the Deputy Commissioner, Srinagar, and Commissioner, SMC, to ensure that status quo was maintained with regard to the property.
The proceedings relate to protection of the property under the J&K Migrant Immovable Property (Preservation, Protection and Restraint on Distress Sales) Act, 1997.
Earlier, the Deputy Commissioner, Srinagar, in an order dated June 7, 2023, directed protection of the petitioners’ land under the J&K Migrant Immovable Property Act, 1997. Another order dated June 5, 2023, passed by the Joint Commissioner Agrarian (Additional Deputy Commissioner), Srinagar, directed the concerned Tehsildar to maintain status quo in the records as well as on the spot and not issue any revenue document concerning the disputed land/property till further orders.
