Srinagar, Sep 21 (JKNS): The Jammu and Kashmir Government has dismissed Khalid Hussain, Teacher Grade-II, from service with immediate effect in connection with the POCSO case, subsequent death of a minor girl from Chatroo in Kishtwar district.
The School Education Department issued Government Order No. 388-JK(Edu) of 2026 on September 21, a copy of which lies with news agency JKNS stated that, imposing the major penalty of dismissal from service under sub-clause (b) of the proviso to clause (2) of Article 311 of the Constitution of India, read with Rule 30(vii) of the J&K Civil Services (Classification, Control and Appeal) Rules, 1956.
The order also disqualifies Hussain from any future employment in Government service in the Union Territory of Jammu and Kashmir.
According to the order, Hussain was posted as Teacher Grade-II at Government Middle School, Bumalpora, Gurinalla, Zone Inderwal, Kishtwar. He was already under suspension and in judicial custody in connection with FIR No. 34/2026 registered at Police Station Chatroo.
The FIR was registered under Sections 61(2), 65(1), 90, 91 and 92 of the Bharatiya Nyaya Sanhita (BNS), 2023, and Sections 4, 6, 8, 10 and 17 of the Protection of Children from Sexual Offences (POCSO) Act, 2012.
The Government order states that, after considering the facts and circumstances of the case and the material available on record, the competent authority was satisfied that the activities of the teacher warranted imposition of a major penalty.
It further states that the competent authority considered it “not reasonably practicable” to hold a departmental inquiry in the case and invoked Article 311(2)(b), which permits dispensing with an inquiry in specified circumstances.
The Government said the case was considered to fall within the category of rare cases and that continuation of the teacher in Government service would be detrimental to the interests of the Government and erode public trust in Government institutions. (JKNS)
