Court Cracks Down: Senior Irrigation Officials Summoned for Failure to Execute Decrees

Anantnag, Nov 6 (JKNS): In a significant development, the Court of the Principal District Judge, Mr. Tahir Khurshidd Raina, has summoned the Commissioner Secretary, Irrigation and Flood Control, Anantnag, to personally appear before the court to explain why he should not be sent to civil prison for the non-execution of the court decrees.

As per news agency JKNS, The court also summoned the Chief Engineer irrigation & Flood Control, Kashmir, Superintending Engineer, Hydraulic Circle Anantnag, and Executive Engineer Flood Control Anantnag directing all other officers/judgement debtors to ensure their personal presence on the next date fixed in the case.

During the hearing of the bunch of execution petitions, the court observed that “obtaining a decree is the easiest part of litigation, but its execution is the most difficult.” Judge Raina emphasized that the judiciary, being “a sentinel on the qui vive,” must ensure that the decrees of the courts get implemented in letter and spirit, and that decree-holders receive the lawful benefits of their claims adjudicated by this court.

Taking serious note of the non-execution of the court decrees over the past five years by the Judgement debtors, the court not only summoned the senior officers of the department who happens to be judgement debtors in the executions but also ordered attachment of their salaries, directing all concerned Treasury Officers to deposit the attached amounts before the court excluding the subsistence allowances as fixed by the government.

The matter has been listed for further proceedings on November 17, 2025, and all the summoned officers have been directed to remain personally present on the said date in the court,

This order comes in line with the recent directions from the Hon’ble Supreme Court, instructing all the courts across India to dispose of the execution petitions. pending in their courts within period of six months, highlighting the judiciary’s firm stance on timely enforcement of the decrees passed by the courts. (JKNS)
