The Kashmir Advocates Association (KAA), a duly registered body recognized by the Bar Council of Jammu & Kashmir and the Hon’ble High Court of Jammu & Kashmir and Ladakh, seeks to inform the legal fraternity and media outlets in particular, and the public in general, about the legal status of the J&K High Court Bar Association, Srinagar Chapter (HCBA Srinagar).
The J&K HCBA Srinagar, contrary to common belief, is not a legally recognized entity. It is an unregistered and unrecognized body with no official standing or legal sanctity. Despite its attempts to present itself as a legitimate association, it is important to note the following:
1. Lack of Legal Recognition:
The J&k HCBA Srinagar is not registered under any legal framework and is not recognized by competent authority.
2. Secessionist Ideology and Terrorism Support:
The association is known for propagating secessionist ideology and supporting terrorism and terrorists within the courts. Such actions are not only illegal but also detrimental to the peace and stability of the UT particularly Valley.
3. Misrepresentation in Media:
It has come to our attention that media outlets often refer to members of this illegal and self-styled association as ‘Chairman of HCBA, ‘Member of HBA, or ‘Ex-President of HCBA.’ We urge the media to present the facts before the general public and refrain from using these titles, as it lends unwarranted legitimacy to an unlawful body. Instead, we recommend referring to them as ‘members’ or ‘chairpersons’ of an illegal and self-styled association. The fact is that the J&K HCBA Srinagar is a self-styled association with no legitimacy or legal footing.
The Kashmir Advocates Association stands firmly against any entity that
undermines the rule of law and the judicial process. We are committed to upholding the principles of justice and legality in Jammu & Kashmir.
We appeal to all media outlets to exercise caution and responsibility in their reporting. Accurate representation is crucial to maintaining the integrity o f the legal profession and the judicial system in our region.
